Where can I find a list of types of test questions?
I am looking for a list of the different types of question I should expect to see on a USPTO patent exam. I am thinking of this list, but I want something more specific. I want something specifically for a robotic patent.
Here’s a (probably incomplete) list of the types of test that you’d receive when you apply to join the USPTO:
Prior art in the form of patents and publications, no prior art during prosecution of an application;
Prior art in the form of patents, but on the same invention/subject matter as the application;
Prior art not in the form of patents, but may be known to the applicant in the form of publications, journals, scholarly articles, etc.;
The USPTO is the inventor of a large portion of patent exam procedure and format, it is a very tricky game they play with you. They throw weird types of questions at you in order to „test“ what you know.
However, as a new member, you’re pretty much expected to be amazed by the sheer amount of information you need to know. And be prepared for questions such as:
Should a two-column format be used?
Can a single publication be used as prior art?
When was a reissue filed?
If multiple documents use the same publication, which document is considered prior art?
What type of envelope will be used by the examiner?
What is the difference between a’series application‘ and ‚continuation application?‘
And, of course:
What is the difference between „files“ and „files and selected claims“?
… and the list goes on. Luckily for you, you do not have to struggle with these, but others have been. Search StackExchange, there’s a ton of related questions.
